KwikSite is an AI website builder operated by Host Local, an Australian website software development and hosting company. These terms govern your use of KwikSite and its services. By creating an account or using the service you agree to these terms. We may update them from time to time by posting the revised terms here; continued use means you accept the changes.
AI output disclaimer - please read
KwikSite builds and edits your website using third-party AI models that you select. The quality, accuracy and suitability of what the AI produces depends heavily on the instructions (prompts) you give and the AI model you choose. AI can make mistakes, misunderstand a request, produce content that is incorrect, or generate results that don't match your expectations.
You are responsible for reviewing everything the AI generates before you publish it. Account credit is consumed each time the AI runs - based on the actual cost of the model you selected - regardless of whether you are happy with the result. We do not provide refunds of consumed credit because the AI got something wrong, misread a prompt, or produced output you didn't like. Choosing a more capable model and giving clearer instructions generally produces better results.
1. The service
KwikSite lets you build, preview, publish and host static websites by chatting with an AI; connect a domain you own or register a new one through us; add contact forms that email you; export your site's files; and pay for usage from prepaid account credit. We may modify, add to, or discontinue features at any time.
2. Accounts
You must be 18 or older (or have the consent of a parent or guardian) to use KwikSite. You are responsible for keeping your login credentials secure and for all activity under your account, and for keeping your account and billing details accurate. Host Local is not liable for loss arising from unauthorised use of your account.
3. Account credit, payments & usage
KwikSite uses a prepaid model. You add credit to your account (processed securely by Stripe) and we draw it down as you use the service - principally AI generation, charged at the underlying model cost plus a margin, and any domain registrations you purchase. Credit is denominated in US Dollars. Prices and rates may change. Card payments are handled by Stripe; we do not store your full card details. Charges appear on your statement as “Host Local”.
4. Refunds
Consumed credit (including AI generation charges) is non-refundable, including where AI output does not meet your expectations (see the AI disclaimer above). Domain registrations are non-refundable once the domain has been registered. Unused account credit is generally non-refundable except where required by law. If you believe you have been charged in error, contact us within 30 days.
5. Domain names
Domains purchased through KwikSite are registered via Amazon Web Services (Route53) on your behalf. Registration is for the term selected (currently one year) and does not auto-renew unless we tell you otherwise - it is your responsibility to renew a domain you wish to keep. Domain registration information may be published in the public WHOIS database as required by ICANN and the relevant registry. Transfers, restorations or changes may incur fees and are subject to registry rules.
6. Your content & acceptable use
You retain ownership of the content you upload and the sites you create. You grant Host Local the rights needed to host, process, display and serve your content to operate the service. You are responsible for your content and must hold the necessary rights to it. You must not use KwikSite to create or distribute unlawful, infringing, fraudulent, malicious or abusive content, to send spam or bulk email, to host malware, or for child sexual abuse material. You must comply with all applicable laws. Sending bulk or unsolicited email via the contact-form feature will result in suspension.
7. Fair use
We monitor usage to keep the service reliable for everyone. Accounts that abuse resources, attempt to circumvent billing, or otherwise degrade the service may be warned, rate-limited, suspended or terminated.
8. Suspension & termination
We may suspend or terminate access for breach of these terms, non-payment, or use that harms the service or others. You may stop using the service at any time. Sites and data associated with a closed or terminated account may be deleted.
9. Third-party services
KwikSite relies on third parties including Amazon Web Services (hosting, email delivery, domain registration), Stripe (payments) and AI model providers accessed via OpenRouter (including Anthropic, OpenAI and Google). Your use of the service involves sending data to these providers as needed to deliver it. Their terms and processing apply to that data; see our Privacy Policy.
10. Disclaimers & limitation of liability
The service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, Host Local is not liable for indirect or consequential loss, loss of data, loss of profit, or for outcomes produced by AI models, and our total liability is limited to the amount you paid us in the three months before the claim.
11. Indemnity
You agree to indemnify Host Local against claims, losses and costs arising from your content, your use of the service, or your breach of these terms.
12. Force majeure
Host Local is not liable for delays or failures caused by events beyond our reasonable control, including outages of upstream providers, natural disasters, or power and network failures.
13. General
If any provision is found unenforceable, the rest remain in effect. A failure to enforce a provision is not a waiver of it. These terms are governed by the laws of Queensland, Australia, and you submit to the courts of Queensland. These terms are the entire agreement between you and Host Local regarding KwikSite.
